A minor is an individual whose personal identity is not yet fully formed and may be subject to conditioning. For this reason, safeguarding personal identity in the digital age is governed by multiple layers of protection.
To better understand the legal protection for individuals of developmental age, it is important to mention Regulation No. 679 of the European Parliament and of the Council, 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, which repeals Directive 95/46/EC (General Data Protection Regulation). In order to align national law with the GDPR, Italian legislation sets the age limit for lawful data processing at 14.
Attached is a regulatory framework on Protecting the Personal Identity of Minors in the Digital Age.
